Cui Bono?

A group of conservative commentators and some Republican Congressmen (including you know who) are urging the president to pardon two Border Patrol agents who were convicted of shooting a drug dealer and trying to cover up the crime. Yes, folks. You read that right.

Rep. Dana Rohrabacher, R-Calif., however, criticized the president for failing to come through with a pardon.

"This is the worst betrayal of American defenders I have ever seen," Rohrabacher said in an interview with WorldNetDaily. "It's shameful this was done by someone who is in the Republican Party. He obviously thinks more about his agreements with Mexico than the lives of American people and backing up his defenders."

Rohrabacher, along with a slew of other lawmakers — including Rep. Ted Poe, R-Texas, have been pursuing last-ditch efforts to free Ramos and Compean. Petitions with more than 225,000 signatures were delivered to the White House Tuesday afternoon.

Here is a fact sheet issued (pdf) by the prosecutor in the case. Some conservatives have argued that because the guy was in the country illegally and a drug dealer who was running away from the commission of a crime, the agents were justified in their actions. Those arguments have driven Patterico (a prosecutor) to write a rebuttal.

The U.S. Attorney in this case has no reason to lie about what happened, and neither do the witnesses used to prosecute the two Border Patrol agent. No one benefits from a malicious prosecution of two guys. If this is some large conspiracy on the part of the Bush administration, then those who are pushing it have yet to explain how prosecuting and convicting these two agents benefits the government of the United States.

A quote from the fact sheet, I believe, sums up the reasons for prosecuting this case so aggressively:

In America, law enforcement officers do not get to shoot unarmed suspects who are running away, lie about it to their supervisors and file official reports that are false. That is a crime and prosecutors cannot look the other way.
I simply cannot believe this case has become such a cause celebre among some conservatives, and a pardon is being advocated by elected Republicans.

This is not the conservatism of the past, that's for certain.

It has become such a cause celebre because of people's discomfort with immigration. Most people, in my insignificant opinion, don't have a problem with the immigrants they meet in everyday, work-a-daddy life, they worry about immigration in a grand, macro-social way.
This cause allows them a short-hand for expressing fears about immigration, without addressing immigration as public policy.
