No to Schiavo

A federal judge has refused to reinsert Terri Schiavo's feeding tube. I agree with Captain Ed's interpretation of this one - it sounds as though the judge didn't reconsider the case anew, as the law instructed. If the judges continue treating this case as an appeal of the case, instead of as a whole new case, this will likely be the result.

UPDATE - It seems like the judge already had some opinion on the case:

"You'd be hard pressed to convince me," Whittemore said of Gibbs's contention that the due-process argument is convincing enough that there would be a strong likelihood of the Schindlers winning if the case went to trial. Whittemore, speaking to 17 lawyers and four tightly packed rows of spectators in his cramped courtroom, said the key to his decision will be his opinion on the likelihood that Gibbs could win a case that numerous Florida courts have rejected.
Emphasis mine. That's not what the law said - Judge Whittemore was supposed to look at this case anew, not base his decision on what the Florida courts did. Judicial activism continues unabated.

UPDATE II - Heaven forgive me, but I'm really starting to dislike this guy. I don't really care what he says about the President or Tom DeLay. What bothers me is this sentence:

Schiavo said he was going to stay at his wife's side through the entire ordeal and said he wouldn't back down in his fight to have her wishes carried out.
Right, buddy. That's why you have a girlfriend and some kids by her. Yes, it would take a very strong man to continue being faithful to Terri when she was in this condition. But, believe it or not, there are some men who have proved it can be done. It irritates me that this guy is being allowed to have it both ways - he's demanding that his wishes as a husband be respected, when he's already abdicated that role with his infidelity.
